UK GDPR is not a box-ticking exercise. Since the UK retained its own version of GDPR post-Brexit, any business processing personal data of UK residents must be able to demonstrate where that data goes and under what legal basis. For AI voice agents, the personal data in question includes call recordings, transcripts, caller identification, and any data extracted from the conversation - all of which can include special category data if the agent handles medical, financial or legal matters.
Bland.ai is a US company operating on US infrastructure by default. When you make a call through Bland.ai, the audio stream, transcription and conversation data flow through Bland.ai's US servers. Transferring personal data from the UK to the US requires a valid transfer mechanism under UK GDPR - typically Standard Contractual Clauses (SCCs). Bland.ai does offer a Data Processing Agreement (DPA), but the default setup puts the burden on you to implement SCCs and document the transfer basis.
For a business running appointment reminders with no sensitive data, this may be acceptable with the right documentation. For any regulated sector - FCA-regulated financial services, CQC-regulated healthcare, SRA-regulated legal firms - we would advise against Bland.ai as the primary platform because maintaining SCCs correctly is an ongoing compliance burden that most SMEs are not equipped to manage.
VAPI is built on infrastructure that allows configuration of data residency at the account level. By selecting Azure UK South as the processing region, all call data - audio, transcripts, function call outputs - is processed and stored in the UK.
